Decision by President of Beirut Bar Association Barring the Candidacy of Mugraby

The Council of the Bar Association at Beirut,

Upon reviewing the application of candidacy to the membership of the Council of the Bar and for the position of President of the Bar, sent personally by Mr. Muhamad Mugraby on September 25, 2003 to the Beirut Bar Association, through the notary public Mr. Adel Abi Rached under number 3899/2003;

And upon reviewing the letter sent by several lawyers to the Bar Association through the notary public Mr. Adel Abi Rached, nominating Mr. Muhamad Mugraby for the membership of the Bar Council and for the position of President of the Bar on September 25, 2003, under number 3898/2003, and of the letter sent to Mr. Muhamad Mugraby to the Bar Association on September 26, 2003 through the notary public in Beirut Mr. Adel Abi Rached, under number 3917/2003,

The Council is of the opinion that:

Assuming that all the formal conditions required for the candidacy applications are fulfilled, and they are not,

With reference to the records of the Bar Association at Beirut it appears that the name of Mr. Muhamad Abdullah Mugraby is no longer listed in the register of the practicing lawyers, pursuant to two disciplinary decisions against him. The first decision was issued on April 4, 2002, forbidding him from practicing the profession for three years, and the second on January 17, 2003, striking him permanently from the register of lawyers. These two decisions are in full force and effect in accordance with Article 110 of the internal bylaws.

As Article 46 of the Code Organizing the Legal Profession requires that candidates should be listed on the roll of practicing lawyers,

And as the conditions of this article are not fulfilled in the above-mentioned nomination applications concerning the candidacy of Mr. Muhamad Mugraby,

Additionally, the conditions of Article 80 of the Code Organizing the Legal Profession are not fulfilled in the candidate.

Therefore,

In accordance with the provisions of Article 48 of the Code Organizing the Legal Profession, the Council decides:

The rejection of the candidacy sent personally by Mr. Muhamad Mugraby to the Bar Association on September 25, 2003, through the notary public, for the membership of the Bar Council and for the position of President of the Bar, and the rejection of the nomination sent by several lawyers on September 25, 2003, and the rejection of the candidacy application sent personally by Mr. Muhamad Mugraby on September 26, 2003.
