Court of Appeal (12th Panel) Chaired by Bou Nacif Decides to Abstain from Dr. Mugraby's Files

This morning, Wednesday December 24, 2003, the 12th panel of the court of appeal, Beirut, held a hearing in which it decided to abstain from the actions in appeal brought by Dr. Muhamad Mugraby, because he had filed (last Saturday) action against the state on account of its responsibility for the acts and decisions of judges of the said panel constituting gross errors. This decision was made pursuant to Paragraph 3 of Article 751 CCP which provides:
"The judge to whom the cause of the action is attributed, and as from the filing thereof, may not perform any of the duties of his office with respect to the plaintiff."
It was noticeable that the court had no other business on its agenda this morning.
